Training Agreement with Simon Stratton Local Motion Personal Training and Nutrition.
Cancellation of Sessions
Cancellations must be made at least 24 hours in advance of the scheduled Personal Training session start time by contacting the PERSONAL TRAINER (either in person, by telephone or e-mail). A Personal Training session cancelled with less than 24 hours notice will be charged at the full rate. The client acknowledges that the company´s cancellation policy will be adhered to in all circumstances where 24 hours prior notice has not been given.
Session Times
All Personal Training sessions will last between 55 to 60 minutes. The member acknowledges that all scheduled Personal Training sessions will start at the scheduled start time and no personal Training session will be extended due to lateness or any interruptions caused by the client.
Duration of Courses
For each Personal Training course purchased, the term of the agreement shall commence on the date of purchase and end 3 months from the purchase date. Any sessions not completed within 3 months will be forfeited and the client will not be entitled to any refund.
Regarding any subsequent courses of Personal Training sessions booked by the client, the term shall commence on the date of purchase and end 3 months from the ‘start date’. Any sessions not completed within 3 months will be forfeited and the client will not be entitled to any refund.
Non-completion of courses for medical reasons
In the event that a medical problem prevents completion of the number of sessions within 3 months a written request maybe submitted to the company. In the event the company exercises its discretion in this respect, the company will inform the client in writing of the extended term.
Payments
In the case of the first course of Personal Training, the member shall pay to the company the amount specified by the company, and the client upon signing this agreement must pay such amount in full. Any subsequent courses must be paid in full when booking the first session of the subsequent course.
Informed Consent
1. Purpose and Explanation of Exercise Program
You will perform an exercise programme which may include weight/strength training, and aerobic conditioning and stretching. This programme is designed to potentially bring about positive changes to your overall health and well-being. The exercise intensity will begin at a low level and increase over time.
2. Attendant Risks and Discomforts
There exists the possibility of certain changes occurring during exercise. These include muscular, tendon and ligament strain; abnormal blood pressure, fainting, irregular, fast or slow heart rhythm, and in rare instances, heart attack, stroke, or death. Every effort will be made to minimize these risks by evaluation of preliminary information relating to your health and fitness.
3. Responsibilities of the Client
Information you possess about your health status or previous experiences of heart-related symptoms (such as shortness of breath with low-level activity, pain, pressure, tightness, heaviness in the chest, neck, jaw, back and/or arms) with physical effort may affect the safety of your exercise programme. You are responsible for fully disclosing your medical history, as well as symptoms that may occur during exercise. You are also expected to report all medications (including non-prescription) taken recently and, in particular, those taken currently. If you begin to experience any of the above-mentioned signs or symptoms it is your responsibility to immediately notify your physician and to obtain medical treatment.
4. Benefits to be expected
The potential benefits of an exercise programme include increased muscular strength and endurance, increased cardiovascular capacity and endurance, increased flexibility and a decrease in certain cardiovascular disease risk factors.

Any questions about the procedures used in the exercise program are encouraged. If you have any concerns or questions, please ask us for further explanations.
6. Use of Records
The information that is obtained during the exercise programme will be treated as privileged and confidential. It is not to be released or revealed to any person without your written consent. The information obtained, however, may be used for statistical analysis or scientific purposes with your right to privacy retained.
7. Freedom of Consent
I hereby consent to voluntarily engage in an exercise programme to potentially improve my capacity and state of cardiovascular and muscular health and well-being. My permission to perform this exercise programme is given voluntarily. I understand that I am free to stop the exercise program at any point, if I so desire.
I have read and understood these Terms & Conditions, including the ‘Freedom of Consent’ terms I will agree to at the commencement of any training course, and I understand the exercise programme procedures that I will perform and the attendant risks and discomforts. Knowing these risks and discomforts, and having had an opportunity to ask questions and had them answered to my satisfaction, I understand I will consent to participate in my exercise programme and thereby will assume responsibility for all risks, liability and damages, which may occur as a result of said exercise programme and in so doing will release Simon Stratton and Local Motion Personal Training and Nutrition, and its agents, trainers and ownership, from all liability and damages.
